Announcement No. 85 of Ministry of Commerce and General Administration of the Customs Promulgating Catalogue of Commodities Subject to Export License

Catalogue of Commodities Subject to Export License in 2006 (see Appendix 1) is hereby promulgated in accordance with Foreign Trade Law of the People’s Republic of China and Management Regulations for Commodity Import & Export of the People’s Republic of China and relative issues are announced as follows:
1. There are 46 commodities subject to export license in 2006 (312 HS codes of 8 places). They are separately subject to export quota license, tender of export quota and export license.
(1) Commodities subject to export quota license are: corn, rice, wheat, cotton, wood products, live ox (to Hong Kong and Macau), live pig (to Hong Kong and Macau), live chicken (to Hong Kong and Macau), natural silk and its products, coal, coke, crude oil, finished oil, rare-earth metal, antimony oxide ore, antimony (including antimony alloy) and antimony products, antimony oxide, tungsten ore, Ammonium Paratungstate, Ammonium metatungstate, Tungsten Trioxide and Blue Tungsten Oxide, Tungstic acid and salt, tungsten powder and its products, Zinc ores, Tin ores, tin and tin-base alloy, and white silver.
(2) Commodities subject to tender of export quota are: Iris and its products, Silicon carbide, Fluorite Block (powder), talc lumps (powder), Light-burned (dead burned) magnesia, alumina, licorice root and its products.
(3) Commodities subject to export license are: live ox (to the market outside Hong Kong and Macau), live pig (to the market outside Hong Kong and Macau), live chicken (to the market outside Hong Kong and Macau), beef, pork, chicken, ozone depleting substance, controlled chemicals, chemicals liable to producing drugs, paraffin wax, platinum (export in the form of processing trade), zine and zine-base alloy, electronic computer, electric fan, bicycle, motorcycle (including all terrain vehicle) and its engine and frame. Among them, controlled chemicals and chemicals liable to producing drugs will be subject to export & export license for dual-purpose biological products and technique, and will be managed in accordance with new measures after the promulgation of Measures on Management of Import & Export License for Dual-purpose Biological Products and Technique.
2. Except the live ox, live pig and live chicken exported to Hong Kong and Macau are subject to country (region) quota license under global license, other exported commodities listed in the catalogue of commodities under export license are subject to global export license.
3. National trade management is put into practice to corn, rice, coal, crude oil, finished oil, cotton, antimony oxide ore, antimony (including antimony alloy) and antimony products, antimony oxide, tungsten ore, Ammonium Paratungstate and Ammonium metatungstate, Tungsten Trioxide and Blue Tungsten Oxide, Tungstic acid and salt, tungsten powder and its products, and white silver.
4. As for the commodities subject to the tender of export quota, no matter what kind of trade form, all authorized license-issuing organs should issue export license by the name list of the enterprises winning the tender and the quantity they have won delivered by the Ministry of Commerce and Certificate of Export License for Applying For the Quota Tender Commodities issued by Tender Office.
5. Other adobe clay under item alumina (HS code 2508400000) is subject to export quota license as of June 1, 2006.
6. Tea export quota license will be cancelled as of January 1, 2006.
7. Following commodities exported in the form of processing trade should be handled in accordance with following rules:
(1) Exporting commodities subject to export quota license in the form of processing trade (except for those stipulated in Section (2), ( 3), (4), (5) of this Article), license-issuing organs should approve and issue export license by export quota, Approval Certificate for Processing Trade Business and the export contract (copy of the original).
(2) For importing raw materials used for producing platinum to process re-exported platinum (platinum or white gold), license-issuing organs should approve and issue export license by Approval Certificate for Processing Trade Business of the competent commercial administration in the area where the operation enterprise made its registration, import declaration form of the customs for processing trade and the export contract (copy of the original).
(3) For importing crude oil to process re-exported paraffin wax, importing silver-bearing commodities (except for aluminium powder, unwrought silver and silver semi-products) to process re-exported silver, and exporting zinc and zinc-base alloy in the form of processing trade, license-issuing organs should approve and issue the license by Approval Certificate for Processing Trade Business of the provincial competent commercial administration in the area where the operation enterprise made its registration, import declaration form of the customs for processing trade, export contract (copy of the original). Among them, the Approval Certificate for Processing Trade Business for silver is approved and issued by the approval document of the Ministry of Commerce, the license-issuing organs should also examine the approval document of the Ministry of Commerce.
(4) For importing licorice root and its products in the form of processing trade, the license-issuing organs should approve and issue export license by Approval Certificate for Processing Trade Business of the provincial competent commercial administration in the area where the operation enterprise made its registration, Certificate of Applying for Export License for Commodities of Processing Trade of China Chamber of Commerce of Medicines & Health Products Importers and Exporters, import declaration form of the customs for processing trade and the export contract (copy of the original).
(5) Importing crude oil to process re-exported finished oil is excused from obtaining export license.
(6) The expiry date of the export license in terms of Section 2, 3 and 4 of this Article should be issued in accordance with the target date for export ratified by Approval Certificate for Processing Trade Business. If the target date for export ratified by Approval Certificate for Processing Trade Business exceeds the end of February of next year, the expiry date of the export license should be issued to the end of February of next year. The enterprise should apply for going through extension formalities before the end of February and the license-issuing organ should approve and issue export license in accordance with the target date for export in Approval Certificate for Processing Trade Business.
8. According to the spirit of Circular of the State Council on Relative Issues About Frontier Trade (No. 2[1996]), the enterprises for border petty trade items still handle export license in the license-issuing organs authorized by the Ministry of Commerce in accordance with current regulations for all commodities subject to export quota tender, ozone layer depleting substance, controlled chemicals, chemicals liable to producing drugs and motorcycle (including all terrain vehicle) and its engine, frame. If the enterprises for frontier petty trade items export the commodities subject to export license for frontier petty items (from item 1st to 23rd in Appendix 2), the export license is approved and issued by the competent commercial administrations of border province or autonomous regions authorized by the Ministry of Commerce in accordance with the export quota for Fortier petty trade items delivered by the Ministry of Commerce. The enterprises for frontier petty trade items export all other commodities listed in the Catalogue of Commodities Subject to Export License in 2006 except for the commodities in terms of this article are excused from obtaining export license.
9. For the purposes of ensuring the implementation of import and export license, to the commodities that are not subject to “one lot one license”, the license-issuing organs should note “non one lot one license” in the “remarks” column of the license while issuing export license.
The commodities subject to “non one lot one license” are:
(1) Commodities exported by foreign invested enterprise;
(2) Commodities exported in the form of processing trade;
(3) Commodities exported under the item of compensatory trade;
(4) Rice, corn, wheat, live ox, live pig, live chicken, beef, pork, chicken, crude oil, finished oil and coal.
The export license of “non one lot one license” may be declare many times at the same customs, but should not exceed 12 times. After declaring 12 times at the customs, the customs should stop accepting the declaration even if there is balance amount in the export license.
10. The samples of controlled chemicals, chemicals liable to producing drugs and ozone layer depleting substance for advertisement should be exported by export license.
11. Announcement will be published later about the commodities relating to textile catalogue subject to export license.
12. The products in this catalogue provided by our government under the item of aid to the foreign countries (except for controlled chemicals and chemicals liable to producing drugs) are not brought into the management of quota and license.
This catalogue shall go into effect on January 1, 2006. Catalogue of Commodities Subject to Export License in 2005 shall be nullified simultaneously.
